1. Overview
Welcome to Ever Evolving Marketing. "We", "us" and "our" mean Ever Evolving Marketing. We run this store and website, including all related information, content, features, tools, products and services (the "Services"). Our store is powered by Shopify.
These Terms of Service ("Terms"), together with the policies they mention, describe your rights and responsibilities when you use the Services. By visiting, using or buying from our Services, you agree to these Terms and our Privacy Policy. If you don't agree, please don't use the Services.
2. Access and account
By agreeing to these Terms, you confirm you are at least the age of majority where you live, or that you have consent for any minors in your care to use the Services on your devices.
You may be asked for information such as your email address and billing and payment details. You confirm that this information is correct, current and complete. You are responsible for keeping your account login safe and for all activity on your account, and you may not transfer or sell your account to anyone else.
3. Our ebooks
Our products are digital ebooks. We work to describe them accurately, but we can't promise that every ebook will meet your expectations. Product descriptions and availability may change at any time, and we may stop offering any product.
Our ebooks share practical steps and tips. Your results depend on your business, budget and how you apply them, so we can't promise any specific results.
4. Your licence to use our ebooks
When you buy an ebook, you get a personal licence to download it and read it on your own devices. You may not copy, share, resell, upload or publish any ebook, in whole or in part, without our written permission.
5. Orders
When you place an order, you are making an offer to buy. We may accept or decline any order, and your order is accepted once we confirm it and receive payment. Please check your order carefully before you submit it. If we decline, change or cancel an order, we will try to let you know using the contact details you gave us.
All sales are final, as explained in our Refund Policy. You confirm that your purchases are for your own personal use and not for resale.
6. Prices and payment
Prices are shown in Canadian dollars (CAD) or US dollars (USD), depending on your country. Prices, discounts and promotions may change without notice, and the price you pay is the price shown when you place your order, as set out in your order confirmation email. Prices may not include taxes.
You agree to give current, complete and accurate payment information, that you are allowed to use the payment method you choose, and that you will pay the charges for your order, including any taxes.
7. Delivery
Your ebook is delivered digitally, by email, right after purchase. Nothing is shipped. If your ebook doesn't arrive or won't open, contact us at hello@everevolvingmarketing.com.
8. Intellectual property
Everything on the Services, including our ebooks, text, images, logos, designs and how they are arranged, belongs to Ever Evolving Marketing or our licensors and is protected by copyright and other laws. You may use the Services for your personal, non-commercial use only.
Our name, logo and product names are our trademarks, and you may not use them without our written permission. Shopify's name and logo are trademarks of Shopify. Other names mentioned, such as Facebook, Instagram and Google, belong to their owners. We are not affiliated with or endorsed by them.
9. Third-party tools and links
The Services may include tools, links or content from other companies. We don't control them and aren't responsible for them, and you use them at your own risk. Please check their own terms and policies before using them.
10. Relationship with Shopify
Ever Evolving Marketing is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our store are made directly with Ever Evolving Marketing. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and Ever Evolving Marketing, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with Ever Evolving Marketing.
11. Privacy
Personal information we collect is handled as described in our Privacy Policy. Some information may also be handled under Shopify's Privacy Policy, because Shopify hosts our store and may process information in other countries.
12. Feedback and reviews
If you send us ideas, feedback or reviews, you allow us to use, share and display them for any purpose, without payment. You confirm that your feedback is your own, is honest, and that you have mentioned any payment or incentive you received for it. We may remove any feedback that is unlawful, offensive or breaks these Terms.
13. Errors
Sometimes the Services may contain mistakes, such as in product descriptions, prices or availability. We may correct them, update information, or cancel orders affected by them, even after you have ordered.
14. Things you may not do
You may use the Services for lawful purposes only. You may not use them to break any law, infringe anyone's rights, harass or harm anyone, share false or misleading information, send spam, or pretend to be someone else.
You also agree not to upload viruses or harmful code, copy or resell any part of the Services, collect other people's personal information, or use bots, scrapers or other automated tools (including AI tools) to access the Services, or get around our security. We may suspend or close your account if you break these Terms.
15. Automated agents
If you use software that acts on your behalf (an "Agent", such as an AI shopping assistant) to use the Services, it must clearly identify itself as an Agent, including its name in the user agent string of its requests ("Agent/[agent name]"). It must not hide that it is an Agent, pretend to be a person, get around CAPTCHAs or other checks, or ignore our limits. We may limit or block any Agent at any time.
16. Ending these Terms
We may end these Terms or your access to the Services at any time, without notice. You remain responsible for any amounts owed up to that date. The sections on intellectual property, feedback, disclaimers, limitation of liability, indemnification and governing law continue to apply afterward.
17. Disclaimer
Information on the Services is for general purposes only. Except as we expressly state, the Services and all products are provided "as is" and "as available", without any warranties or conditions of any kind, including merchantability, fitness for a particular purpose and non-infringement. We don't promise that the Services will be uninterrupted, secure or error-free. Some places don't allow these exclusions, so they may not all apply to you.
18. Limitation of liability
To the fullest extent the law allows, Ever Evolving Marketing, Shopify, and our partners, staff and service providers are not liable for any indirect, incidental, special or consequential damages, including lost profits, revenue or data, arising from your use of the Services or any product, even if we were told such damages were possible.
19. Indemnification
You agree to protect Ever Evolving Marketing, Shopify and our partners from any claims, losses or costs, including reasonable legal fees, caused by your breaking these Terms or the law, or by your use of the Services. We will let you know about any such claim, and you agree to help with the defence.
20. Other terms
If any part of these Terms can't be enforced, the rest still applies. If we don't enforce a right, we haven't given it up. These Terms and our policies are the full agreement between you and us. You may not transfer your rights under these Terms without our written permission, but we may transfer ours. Headings are for convenience only.
21. Governing law
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there.
22. Changes to these Terms
We may update these Terms by posting the new version on this page. The date at the top shows the latest version. If you keep using the Services after a change, you accept the updated Terms.
